Conditions of Service
Effective Date: May 1, 2026
By engaging Eden Grounds and Gardens ("we", "us", or "our") for services, you ("the client") agree to these Terms and Conditions.
1. Services
We provide lawn mowing, garden maintenance, hedging, treatments, gutter cleaning, pressure washing, and related outdoor services as agreed.
All services are performed with due care and skill.
2. Gift Vouchers
Digital gift vouchers are valid for a minimum of 3 years from the date of purchase, in line with Australian Consumer Law.
The expiry date will be clearly stated on each voucher.
Vouchers are non-transferable and non-refundable for cash.
Vouchers can only be redeemed for services provided by Eden Grounds and Gardens.
Any balance remaining after redemption will remain on the voucher until expiry.
We reserve the right to refuse redemption if the voucher code has already been used, is expired, or is suspected to be fraudulent.
Vouchers cannot be used in conjunction with other offers unless specified.
Lost or stolen vouchers will not be replaced.
3. Quotes and Pricing
Quotes are valid for 30 days and based on site inspection or provided details. Prices include GST and may vary if site conditions differ from the description. Additional work requires approval and may incur extra charges at $100 per hour (pro-rated).
4. Payment
Payment is due on completion of service unless otherwise agreed. Invoices unpaid after 7 days may incur a $50 late fee. We accept bank transfer, cash, or card (2.2% surcharge applies for card payments).
5. Scheduling and Access
Appointments are scheduled by mutual agreement. You must provide safe, clear access to the property. Locked gates, obstacles, or unsafe conditions may result in rescheduling and potential fees. For pressure washing and gutter cleaning, you must ensure pets are secured indoors, vehicles and outdoor furniture are moved or covered, and drainage systems are clear and functional.
6. Specific Service Conditions
Gutter Cleaning: Includes removal of leaves and debris. We do not repair gutters, replace parts, or clear internal downpipe blockages unless specifically quoted.
Pressure Washing: Performed at appropriate pressure levels. We are not liable for pre-existing damage such as loose grout, cracked tiles, faded paint, or delicate surfaces. We do not access roofs unless agreed in writing with appropriate safety measures.
7. Cancellations and Weather
Cancellations with less than 24 hours' notice may incur a $50 fee. Services may be rescheduled due to rain or unsafe conditions at no extra cost.
8. Liability and Insurance
We carry $20 million public liability insurance. We are not liable for:
Pre-existing damage to surfaces, paintwork, tiles, or seals
Damage caused by hidden cracks, loose tiles, or faulty drainage
Water ingress due to blocked or damaged gutters/downpipes
Any damage resulting from client-provided access issues
Our total liability is limited to the value of the service provided.
9. Green Waste
Clippings and green waste are left or removed as per the service agreement. Excessive green waste removal is charged separately.
10. Termination
Either party may terminate ongoing services with 14 days' written notice.
11. Disputes
Any disputes will be resolved amicably. Governing law: New South Wales, Australia.
12. Changes to Terms
We may update these terms. Continued use of services constitutes acceptance.
